Welcome to Aspire Aviation Academy. The terms “we”, “us”, and “our” refer to Aspire Aviation Academy. We operate this website and online store, including all related information, content, features, tools, products, and services (the “Services”). Our store is powered by Shopify.

These Terms of Service, together with the policies referenced below (the “Terms”), describe your rights and responsibilities when using the Services. By visiting, interacting with, or purchasing through the Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, do not use the Services.

SECTION 1 — ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your state or province of residence and that any information you submit is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer or sell your account.

SECTION 2 — OUR PRODUCTS AND SERVICES

We aim to display products and services accurately. Actual colors and finishes can vary by device. Descriptions, pricing, and availability may change without notice. We may limit quantities or refuse service to any person or region at our discretion.

SECTION 3 — ORDERS AND ALL-SALES-FINAL POLICY

Placing an order is an offer to purchase. We reserve the right to accept or decline any order. Payment must be processed before acceptance. All sales are final and non-refundable except for the limited exceptions described in our Return & Refund Policy [LINK] for items that arrive damaged, defective, or incorrect.

Orders cannot be canceled once accepted. If we decline or cancel an order, we will attempt to notify you using the contact information provided at checkout. You represent that purchases are for personal use and not for resale or export.

SECTION 4 — PRICES AND BILLING

Prices, promotions, and discounts may change without notice. The price at checkout is the price that applies. Unless stated otherwise, prices exclude taxes, shipping, and handling. You agree to provide current and accurate billing details and authorize us to charge your payment method for the full amount due, including applicable taxes and fees.

SECTION 5 — SHIPPING AND DELIVERY

Shipping is available within the United States using USPS, UPS, and FedEx. Rates are calculated at checkout. Orders typically ship within 3 to 5 business days. Delivery times are estimates and not guaranteed. Title and risk of loss pass to you when the order is transferred to the carrier. We are not responsible for delays due to carriers, weather, or events outside our control, and we are not responsible for incorrect or incomplete addresses entered at checkout. SECTION 6 — TRAINING, DISCOVERY FLIGHTS, RENTALS, AND SIMULATORS

Scheduling is required for discovery flights, flight training, aircraft rentals, and simulator sessions, and is subject to instructor, aircraft, and device availability.

• All bookings are non-refundable. Rescheduling windows are defined in our Purchase Options Cancellation Policy [LINK]. As of today

  • Discovery flights may be rescheduled with at least 48 hours’ notice

  • Simulator sessions may be rescheduled with at least 24 hours’ notice

  • Aircraft rental reschedules are at dispatch discretion and subject to availability

  • No-shows or late arrivals may forfeit the session and fees

• Aircraft checkout and currency requirements apply for rentals. You must meet our internal checkout standards before renting.

• Operational changes may occur due to weather, maintenance, or safety considerations. We may delay, shorten, or reschedule any session in our sole discretion for safety. Our liability is limited to rescheduling the affected time.

SECTION 7 — INTELLECTUAL PROPERTY

All trademarks, logos, text, images, graphics, video, audio, and site design are owned by Aspire Aviation Academy or its licensors and are protected by law. You may use the Services for personal, non-commercial purposes only. No license is granted to reproduce or distribute any content without our prior written consent.

SECTION 8 — OPTIONAL TOOLS AND THIRD-PARTY LINKS

We may provide access to third-party tools and links. They are provided “as is” and “as available” without warranties and at your own risk. Review third-party terms and policies before use. We are not responsible for third-party content, products, or services.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify. Purchases are made directly with Aspire Aviation Academy. Shopify is not a party to your transaction and is not responsible for any injuries, damages, or losses related to your purchases. You release Shopify and its affiliates from claims arising from your transactions with us.

SECTION 10 — PRIVACY

Personal information is handled per our Privacy Policy [LINK] and may also be processed by Shopify in accordance with Shopify’s privacy policy. Using the Services constitutes your consent to these practices.

SECTION 11 — FEEDBACK AND REVIEWS

If you submit ideas, reviews, or other content (“Feedback”), you grant us a worldwide, perpetual, sublicensable, royalty-free license to use and display that Feedback for any purpose. You represent that you own the Feedback and that it does not violate any rights or laws. We may remove content that we deem unlawful or inappropriate.

SECTION 12 — ERRORS, INACCURACIES, AND OMISSIONS

Information on the Services may contain errors or omissions. We may correct or update information or cancel orders if any information is inaccurate, including after an order is submitted.

SECTION 13 — PROHIBITED USES

You may not use the Services for any unlawful purpose, to violate rights, to transmit malware, to spam, to scrape, to impersonate others, or to interfere with security or site operations. We may suspend or terminate access for violations.

SECTION 14 — TERMINATION

We may suspend or terminate access to the Services at any time. You remain responsible for all amounts due up to the date of termination. Sections that by their nature should survive will continue to apply.

SECTION 15 — DISCLAIMER OF WARRANTIES

Except as expressly stated by Aspire Aviation Academy, the Services and all products and services are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow limitations on implied warranties, so these limits may not apply to you.

SECTION 16 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, Aspire Aviation Academy and its officers, employees, agents, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or use, arising from or related to the Services, products, or bookings, even if advised of the possibility of such damages.

SECTION 17 — INDEMNIFICATION

You agree to indemnify and hold harmless Aspire Aviation Academy and its affiliates, officers, employees, and agents from claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms, your violation of law, or your misuse of the Services.

SECTION 18 — SEVERABILITY

If any provision of these Terms is held unlawful or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.

SECTION 19 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce a provision is not a waiver. These Terms, together with policies referenced here, are the entire agreement between you and us regarding the Services.

SECTION 20 — ASSIGNMENT

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms without notice.

SECTION 21 — GOVERNING LAW

These Terms are governed by the laws of the State of Missouri and applicable federal laws of the United States. You consent to exclusive jurisdiction and venue in the state and federal courts located in Missouri.

Headings are for convenience only and do not affect interpretation.

SECTION 23 — CHANGES TO TERMS

We may update these Terms from time to time. Changes take effect when posted unless a later date is stated. Your continued use of the Services following changes constitutes acceptance.
